Enduring Power of Attorney UK

Power of Attorney:

Authorisation to act on someone else's behalf in a legal or business matter.

The person authorising the other to act is the donor (of the power), and the one authorised to act is the attorney.

Enduring Power of Attorney (UK) Forms

The Enduring Power of Attorney (EPA) forms a step in the prevention of elderly abuse. The Enduring Power of Attorney Act 1985 introduced the standard statutory durable Enduring Power of Attorney format template form.

The difference between Power of Attorney and Enduring Power of Attorney is that a standard Power of Attorney is a nondurable Power of Attorney; that is, it is not a durable Power of Attorney in the event of mental incapacity. The non-durable Power of Attorney will lapse if the donor becomes incapacitated whereas the legal Enduring Power of Attorney forms a way of appointing a financial nominee to act on the donor’s behalf.

The Enduring Power of Attorney did not allow medical health care decisions by the nominated attorney. The Enduring Power of Attorney ends on death of the donor.

Enduring Power of Attorney changes came into force in 2007 so that no further Enduring Powers of Attorney could be written and were replaced by Lasting Powers of Attorney.

Ordinary Power of Attorney Forms

Standard Power of Attorney forms give the attorney certain powers which are revoked on mental incapacity or death of the donor.

A General Power of Attorney form means the attorney will have control over all the donor’s finances whereas a special or limited Power of Attorney form restricts the attorney’s powers to specific transactions.
